(a) A person who violates this article shall be guilty of a Class C felony.
(b) A person who commits a class C felony and who commits a Class B felony, or other misdemeanors under this article (other than any of sections 1141 through 1147 of this title), is guilty of a Class A misdemeanor.
(c) An act committed under this article has the force or effect of being unlawful or having a substantially disproportionate effect, if the act was done in good faith, in compliance with a written order, or in the manner that is necessary to protect the safety or well-being of the person concerned.
(d) If a person is charged with a violation under this article, the court shall order the release of such person. The person detained shall not receive treatment, and, while released, shall comply with the terms and conditions of his or her bond or certificate authorized by the court.
